Terms of use

What this service is

• Tallyprice compares shop prices, publishes specification sheets with the manufacturer's source and its date, and adds verdicts signed by a person. It is free and you do not need to register to use it: we ask for an email address only if you want to follow a price.
• Using the site means accepting these terms. If you disagree with one of them, the consistent thing is not to use it.
• We may add categories, drop others, change the design or stop publishing a product page without notice. What we will not do is change the ranking criterion without saying so on the page that explains it.

Nothing is bought here

• We sell none of the products shown. Press an offer button and you leave for the shop, and that is where the contract is formed: the final price, the payment, the shipping, the invoice, the warranty and the return are with them.
• The prices you see are the ones the shop gave us, with the time of the last check written beside them. Between that time and your click the shop may have changed it. The price that counts is the one in the shop's basket before you pay.
• The shipping costs we show are the ones the shop declares for the market you are viewing. An island address, a delivery abroad or an express service can cost something else.
• If an offer has expired and you press its button, we do not send you to the shop: we return you to the product page with a notice. We would rather do that than land you on a price we can no longer stand behind.

How we make money, in one line

Shops pay us a commission when you buy through our links, it costs you nothing extra, and that commission has no effect on the ranking. The affiliate disclosure explains it at length.

Permitted use

• Use the site to inform yourself, compare and buy, as often as you like, from wherever you like.
• Quote our figures, sentences or a table by saying they come from Tallyprice and linking to the page they are on. Link to us from anywhere without asking.
• If you read the site with an automated system (an assistant, an agent, a crawler), the condition is the one that applies to a person quoting us: the figure travels with its date and its source. Our robots.txt lets them through on purpose.

Use that is not permitted

• Extracting the catalogue or a substantial part of it by automated means, rebuilding it elsewhere, or reselling it, with or without a link.
• Working around technical limits, probing the admin panel or internal addresses, or sending requests at a rate that degrades the service for others.
• Passing our content off as your own, or framing it in a way that hides where it comes from.
• Using the site for anything unlawful, or to impersonate Tallyprice or one of the shops linked here.

What we do not promise

• We do not guarantee an offer is still live or in stock when you arrive at the shop. Data is refreshed at intervals, not in real time.
• We take care that the specification is the manufacturer's and that gaps stay empty, but a manufacturer can publish a wrong figure or change it without notice. When we get it wrong we correct it and say so: write to affiliates@tallyprice.com.
• A verdict is a reasoned opinion about what the specification says. It is not personal buying advice, not a lab test, and no substitute for reading the product's own documentation.
• A stated calculation is a calculation with its assumption written first. It exists to compare two products on the same basis, not to promise you a result at home.
• The site can be down, under maintenance or incomplete. We do not promise continuous availability.

Following prices

• Following prices is a free account with no password: it opens with a link we email you and closes in one click from your panel or from the footer of any email, deleting everything of yours.
• We email you at most once a day, at the time you choose, and only if something has moved: a drop of 3% or more, a rise of 5% or more, or the target price you set.
• An alert is not a reservation or a price lock. It is worked out from our data, which can lag behind the shop, and it can arrive after the offer is gone.
• We do not send you advertising and we do not hand your address to anyone.
• An account you do not open for twelve months is deleted. We email you fourteen days before.

Liability

• We answer for what we publish: for the price shown as of the time we state, for the specification matching the source we cite, and for the ranking being the one explained.
• We do not answer for what a shop we sent you to does or fails to do, for damage arising from the use of a product, or for the content of the pages we link to.
• We do not answer for lost profit or indirect damages arising from use of the site, to the extent the law allows.
• None of this excludes liability that cannot be excluded by law, including for wilful misconduct and gross negligence.

Changes, severability and assignment

• When these terms change, the new version carries its date at the bottom, and a change of substance is flagged visibly on the page for a reasonable period.
• If a clause turns out to be invalid, the rest stand and the invalid one is replaced by the closest valid equivalent.
• Not enforcing a right under these terms at some point does not mean we waive it.
• We may assign these terms to another company in the group in a reorganisation, without worsening your rights.

Complaints and disputes

• Write to legal@tallyprice.com first. Most of what arrives is settled by fixing the site.
• These terms are governed by the laws of the State of Florida, United States, and the state and federal courts of Pinellas County, Florida shall have jurisdiction over any dispute.
• If you are a consumer, this does not remove the rights that the mandatory law of your country of residence gives you, nor your right to bring a claim in the courts of your own domicile.
• We are not signed up to any consumer arbitration scheme or code of conduct. Since we do not sell, there is no sales contract of ours to take to an online dispute resolution platform either: that route belongs to the shop you bought from.
